Who is responsible for your personal data?
Nieuwkans BV is the data controller of your personal data within the meaning of the AVG. Through this Privacy Statement, Nieuwkans BV wishes to inform you about the processing of your personal data.
How do we handle your personal data?
Nieuwkans BV respects the privacy of visitors to our website and the personal data we process as part of our business activities. If you submit questions to us via the contact form on our website, we process your personal data in order to contact you and answer your questions.
If you are an employer/client, we process your organisation's contact details to make appointments on behalf of your employees for whom we offer our services such as sustainable employability and outplacement. The legal basis for processing employees' personal data is the contractual agreement that exists between the employer and employee. In all cases, we do not process more personal data than necessary.

How long will your personal data be kept?
Your personal data will not be kept longer than necessary. In case of a customer relationship, your personal data will be kept for 7 years after termination of services.
For assignments in the context of sustainable employability or outplacement, employees' personal data will be deleted no later than 3 months after completion of the assignment.
How are your personal data secured?
Nieuwkans BV values your privacy. We therefore take security measures to prevent theft, loss or other unlawful use of your personal data. Among other things, we use secure connections and, where necessary, encrypted communication. We also take measures with regard to physical and logical access security. Our consultants use equivalent security measures, which we have agreed with them in a processing agreement.
Will your personal data be disclosed to third parties?
Nieuwkans BV will not provide personal data to third parties without your knowledge, unless we are required to do so by law, for example based on a lawful demand from competent authorities. We will provide no more personal data than is necessary to our consultants for guidance of your employees in the context of sustainable employability or outplacement
Are your personal data processed outside the EEA?
For processing your personal data, Nieuwkans BV uses software which is maintained in the EEA and archives your personal data outside the EEA. For processing outside the EEA, we have taken appropriate safeguards which comply with the recommendations of the European Data Protetion Board (EDPB) November 2020.
What are your rights as a data subject?
You as a data subject have been given rights through the AVG. You can submit your request to see, correct or delete your personal data? You can submit a request for inspection by sending an email to info@nieuwkans.nl. To verify your identity, Nieuwkans BV asks you to send a copy of your proof of identity in which your passport photo and BSN number have been made invisible. Following this request for inspection, you can ask Nieuwkans BV to amend or remove your personal data.
What if you have a complaint about the processing of your personal data?
If you have a complaint about the processing of your personal data, please be sure to let us, Nieuwkans BV, know. Should you not come to an agreement with me, you have the right to file a complaint with the privacy regulator, the Personal Data Authority.
